This notice is provided by Leapfrog Power, Inc., doing business as Leap, a California-based demand response aggregator. Leap operates as a covered entity under PG&E Electric Rule No. 27, SCE Electric Rule No. 25, and SDG&E Electric Rule No. 33 when it accesses, collects, stores, uses, or discloses covered customer energy usage information obtained through PG&E's Advanced Metering Infrastructure (AMI).

3. What Information We Collect
When you authorize Leap to access your utility account, we may collect the following categories of information:
Energy Usage Data
Consumption and interval data obtained through AMI, including your SmartMeter™ readings. This includes historical usage, near-real-time usage, and demand data associated with your service account.
Personal Information
Information that identifies you or your premises, including your name, service address, email address, utility account number, and rate schedule.
Non-Personal Account Information
Rate classification, tariff schedules, and other account attributes that do not directly identify you but are associated with your service account.
4. How We Use Your Information
Primary Purposes
Leap uses your energy usage information to plan, implement, and evaluate demand response and energy management programs, including:
Providing demand response, grid flexibility, and related ancillary services on your behalf
Scheduling and dispatching demand response events or load adjustments in response to grid signals or pricing mechanisms
Administering and improving demand response programs, including building data models to optimize grid service performance
Assessing and improving resource performance in DR events
Responding to and resolving billing or invoicing disputes related to demand response compensation or credits
Sending operational communications including confirmations, alerts, and program-related administrative messages
Secondary Purposes
Leap does not currently use your energy usage information for secondary purposes without your express written authorization. Should Leap seek to use covered information for any purpose beyond those listed above, we will obtain your prior, express, written authorization before doing so.
5. How We Share Your Information
Leap does not rent, sell, or share your energy usage information with third parties except as described here:
Authorized Partners for Demand Response Programs
Leap collaborates with utilities, demand response aggregators, grid operators, and other program partners to deliver grid services. We may share your energy usage information with these partners as necessary to carry out the demand response or grid services program in which you are enrolled. All such partners are contractually required to handle your information under data privacy protections no less stringent than those described in this notice.
Service Providers
Leap works with third-party service providers, including database administrators, cloud computing services, and application service providers, who assist us in delivering our services. These providers are authorized to use your information only as necessary to provide services to Leap on your behalf and are contractually bound to handle your information in accordance with applicable privacy rules.
Legal Process
Leap will not disclose your energy usage information pursuant to a subpoena or other legal process without first notifying you in writing and giving you at least 7 days to appear and contest the disclosure, unless prohibited by court order, applicable law, or Commission directive. Leap will not disclose your energy usage information except pursuant to a warrant or court order specifically identifying you, unless otherwise required by applicable law or authorized by the Commission.
Emergency Disclosures
In situations involving an imminent threat to life or property, Leap may disclose your information to emergency responders without prior notice or authorization.
Aggregated Data
Leap may aggregate your energy usage data with that of other customers in a manner that removes all personally identifiable information. This anonymized, aggregated information may be used for analysis, reporting, and program management and may be shared with third parties. Aggregated data that cannot reasonably be used to re-identify you is not subject to the restrictions in this notice.
6. How Long We Retain Your Information
Leap retains your information indefinitely in accordance with applicable legal obligations, unless otherwise requested. Customers that wish to have their data deleted should reach out to the email account listed above.
7. Your Rights: Access, Correction, and Control
Access
You have the right to request convenient and secure access to your energy usage information held by Leap. Upon request, Leap will provide your information in an easily readable format at a level of detail no less than that at which it is disclosed to third parties. To submit an access request, contact our customer support team using the information in Section 2.
Correction
You have the right to dispute the accuracy or completeness of your energy usage information and to request corrections or amendments. Customers wishing to dispute their underlying usage data should also follow the procedure set forth by their utility.
Control Over Secondary Uses
You may grant or revoke authorization for any secondary use of your energy usage information at any time using the contact information provided above.
Limiting Collection and Use
You may request that Leap limit its collection, use, storage, or disclosure of your energy usage information. Please note that certain limitations may affect Leap’s ability to provide demand response or grid services to you.
8. Data Security
Leap implements reasonable administrative, technical, and physical safeguards designed to protect your energy usage information from unauthorized access, destruction, use, modification, or disclosure. In the event of a security breach affecting your covered information, Leap will notify your utility within one week of detection, and your utility will notify the California Public Utilities Commission in accordance with applicable requirements.

Leap may change this notice if regulations or operations change. If Leap materially changes this notice, we will inform your technology provider of the changes and the process by which you may access prior versions.
